I don't think inter-sample peaking is actually a problem - as there is no reason the digital peak of a sampled signal is as large as the largest peak of the analog signal it represents. Calculating the in between samples during upsampling very likely means you new digital peak will be larger than at the lower sample rate.

This seems totally consistent with digital theory.
