When such a device appears one would expect that in a first step some sort of solid, unbiased, repeatable evidence is provided that shows that the devices really works. In a second step one would try to establish how the device works. So far there is no evidence at all. The fact that at least one of the cups is active in the audible range does not mean that it has an audible effect. This has still to be proved. The evidence for ultrasonic hearing apparently is suffering from methodological flaws.
