Just wanted to get a reality check here. If you purchase tubes on eBay and the seller does not mention that they have tested for microphonics or noise, does the seller still have some responsibility to the buyer in this regard if the tubes do turn out to be bad - i.e. noisy and microhonic?

I ask because I am involved in just such a discussion with a seller who I thought was trustworthy as they have had many positive feedbacks left for them...

My belief is that if you are selling tubes for audio applications there is an implied merchantability...just as if you were selling a car and neglected to mention that it does not, in fact, run.

Thoughts? I am crazy to have this expectation? Caveat Emptor?
