I had the same problem-aseller lifted my photos and description directly from an auction and used them in thier listing.Ebay has written rules concerning text and image theft (if you can find it deep into the annals ao thier policy).
I sent Ebay an email complaint. They came back with "we do not see enough similarity".
They must be blind, as it was a blatant theft of MY images and descripton verbatum. I don't think they even looked at it, they just sent me an automated email.
