I hear the similarity

I definely hear it. It's in the verses AND the changes. It might be in a different key, but it's the same musical progression. If you were to play the chord progression on a guitar you could easily sing BOTH lyrics to it.

Not sure how they make a judgement about how much similarity makes a "copy", but those two songs had too much in common. I don't think it was an intentional thing. You have a lot of songs that sound alike.

Like the other posts, you hear it every day. Just this morning, I'm listening to SOMAFM.com -(Indypoprocks) when up plays The Decemberists - "Angel Won't You Call Me". The repeating intro guitar plays the EXACT lines of the Traveling Wilbury's "Handle Me With Care". And there's even a 12 string guitar in the song.

Now does playing that intro constitute a case? The music deviates from said song in other parts of it. I think if a song has a certain amount of content, let's say approx. 3/4 of the song, you could have a case. But I'm sure a lot of factors come into play, such as if that song had national airplay etc...
